There was a window in 1986 and 1987 for Malaysia to negotiate and review price under the first and second agreement but they missed that window because someone was sleeping on the job.  And guess what?  It happened during Mahathir's term as PM.....

Singapore’s position has consistently been that neither Malaysia nor Singapore can unilaterally change the prices of raw water and treated water specified in the Water Agreements. Under the Water Agreements, Singapore pays Johor 3 sen per thousand gallons of raw water and Johor pays Singapore 50 sen per thousand gallons of treated water. 50 sen is only a fraction of the true cost to Singapore of treating the water, which includes building and maintaining the entire infrastructure of the water purification plants. The Water Agreements provided for a price review after 25 years. This would have been in 1986 for the 1961 Water Agreement and in 1987 for the 1962 Water Agreement. Malaysia chose not to review the price of water then. Malaysia has therefore lost its right to review the price of water.



It is like you signing a loan with HDB with a clause for review on the loan rates after 10years but the bank forgot to review the rate at the 10th year window.  Now after 15years they unilaterally want you to agree to their new terms? ???

MORE THAN S$1 BILLION SPENT ON WATER PROJECTS IN JOHOR

Dr Balakrishnan noted that in 1990, during Dr Mahathir’s first prime ministership, PUB and Johor had signed an agreement to construct the Linggiu Dam to increase the yield of the Johor River.

Johor owns the Linggiu Dam, but Singapore, he said, paid more than S$300 million for its construction and operational costs, as well as compensation for the land used for the Linggiu Reservoir, the potential loss of revenue from logging activities, and as a one-time payment of the lease of that land for the remaining tenure of the 1962 Water Agreement.

“If Malaysia had exercised the right to review the price of water in 1987, Singapore might well have made different investment decisions on developing the Johor River,” he said, pointing out that overall, Singapore has so far spent more than S$1 billion on water projects in Johor.


He said that this has helped to ensure that not only PUB’s waterworks, but Johor’s own waterworks can reliably draw water from the Johor River.

"In this period of dry weather, Singapore continues to provide Johor additional treated water upon their request," he said.

"We do so out of goodwill, without prejudice to our legal rights under the Water Agreement. "
