Doctor accused of raping patient goes on trial

A doctor who was attending to his regular female patient allegedly raped her after she had gone to him complaining of an itch in her genitals and frequent urination.

The victim testified in a closed-door hearing on the opening day of the trial on Monday (Apr 30).
Wee Teong Boo, 67, is accused of committing the offence while examining the victim, who cannot be named due to a gag order.

In their opening address, Deputy Public Prosecutors Sharmila Sripathy-Shanaz, Amanda Chong and Chew Xin Ying said that on Dec 30, 2015, the victim, who was then 23, visited Wee’s clinic in Bedok at about 11.30pm.

According to court documents, after the victim lay down and pulled up her T-shirt for Wee to examine her abdomen, he pulled the victim’s shorts down. He then rubbed her private parts over her underwear, asking if that was what was itchy.

Wee then asked her to lower her shorts and underwear further in order to check her private parts. She pulled them to thigh level, but he asked her to remove them, and he proceeded to remove them completely.

Wee then positioned the victim such that he was between her legs. Court documents show that the victim heard the sound of a zipper. She then felt a poking sensation in her genitals, and saw Wee’s body moving forward and backward with each poking sensation.

Wee re-positioned the victim when she complained of pain. It was then that the victim managed to see what was in her private parts. Wee’s pants were unzipped, and when the victim went to the toilet immediately after, she found blood stains.

“Still in a state of shock, the victim collected her medication and left the clinic,” the prosecutors said in their opening address.

VICTIM COULD NOT SLEEP THAT NIGHT

Later, when she showered and washed her private parts, she felt pain and found bloodstains when she wiped herself after using the toilet throughout the night, the court heard.

She was also unable to sleep and confided in her mother, who found her awake and tossing and turning in bed in the early hours of the morning. On the same day, she made a police report.

According to court documents, the victim suffered a hymen tear and and two small wounds.
Court documents also show that a month before the incident, Wee rubbed the victim's private parts over her underwear while examining her for gastric discomfort.

While the victim felt uneasy she did not voice her discomfort, as she assumed it was part of the medical examination and she trusted her doctor, who she had been seeing for about a year, the court heard.

Wee was charged with rape and molest on Feb 24 last year.

In a first of its kind for an ongoing court case, the Singapore Medical Council ordered that he be barred from carrying out consultations with female patients unless he is accompanied by a female doctor acting as a chaperone.

He also cannot examine the breast, pelvic, genital or anal areas of female patients, according to the 18-month order that came into effect on May 1 last year.

The prosecution is expected to produce 15 witnesses over the trial period.
If convicted of rape, Wee faces 20 years in jail and a fine.

The maximum penalty for outrage of modesty is two years’ jail, fine, caning, or any combination of punishments. However, as he is above 50 years old, no caning will be imposed.

Usually when I'm sick the gp refer me to specialist after second to third visit ...

Tests done by the Health Sciences Authority (HSA) on the underwear of a 26-year-old woman who is accusing her doctor of molest and rape have shown no traces of semen, with insufficient DNA detected.

Swabs done on the woman's vagina also tested negative for traces of semen, a court heard on Monday (May 7).

HSA analyst Tan Ying Ying was one of four witnesses called to the stand on the fifth day of the trial of Wee Teong Boo, 67. He is accused of molesting and raping the woman, then a 23-year-old student, during two visits in late 2015. She cannot be named due to a gag order.

The court heard that the alleged victim's underwear had been soaked in a pail of water for at least 11 hours before it was seized by the police and tested by the HSA. She wore the underwear when the alleged rape took place in the early hours of Dec 31, 2015.

Ms Tan said that in general, soaking can lead to a loss of DNA and semen.

As there was a brown stain on the woman's underwear, it was also tested for blood as a matter of procedure. The test came back negative. Ms Tan clarified that this does not rule out the possibility that the stain was blood as it might have been too diluted to be detected as such.

The woman had also washed her vaginal area with soap and water after the alleged offence. When asked if that would affect the results of the swab, Ms Tan said: "In general, washing can lead to a loss of semen."

Examinations were also done on the shirt, pants and underwear that Wee was said to have worn at the time of the alleged rape. But tests for DNA were inconclusive as multiple sources of DNA were found on all pieces of his clothing.

The examination bed in Wee's clinic, where the alleged rape took place, was also swabbed and tested for blood and DNA. The results were negative and inconclusive due to multiple DNA profiles belonging to at least four people.

These DNA profiles cannot be pinpointed as belonging to either the alleged victim or Wee, the court heard.

The swabs, the clothing and the underwear were all taken on the afternoon the woman made a police report against Wee on Dec 31, 2015.

Wee has pleaded not guilty to one count each of rape and molestation.

The trial continues tomorrow (May 8) when Dr Janice Tung, who examined the woman and found a fresh tear in her hymen, is expected to take the stand.

The doctor accused of molesting and raping his former patient said wounds on her genitals and a fresh tear in the hymen may have been caused by him inserting two of his fingers for a medical examination.
This emerged on Tuesday (May 8) on the sixth day in the trial of Wee Teong Boo, 67, when his lawyer Edmond Pereira cross-examined the prosecution's witness - Dr Janice Tung, an associate consultant at KK Women's and Children's Hospital.

Wee is accused of molesting and raping the woman, then a 23-year-old student, on Dec 31, 2015. She cannot be named due to a gag order.

During her testimony, Dr Tung said she found two superficial wounds on the alleged victim's genitals and a fresh tear in the hymen during a medical examination which she performed on the woman after the alleged rape.

Dr Tung said she was told by the woman that she had no prior sexual encounters. The alleged victim also said she saw Wee's penis and indicated that he had penetrated her. Dr Tung said the woman's account of what happened was consistent with her injuries.

Mr Pereira asked Dr Tung whether penetration by fingers can cause similar injuries and she said it was possible.

The defence counsel said he was instructed by his client that Wee had inserted two of his fingers inside the woman as he observed redness on her genitals and suspected a pelvic inflammation. Wee then diagnosed her with pelvic inflammatory disease and prescribed her medication.

The woman had seen Wee on the night of the alleged rape because of frequent urination and genital itch. During her examination, Dr Tung found that the woman suffered from a bacterial and yeast infection.

Mr Pereira asked whether by scratching and rubbing her itch, the woman could have caused the injuries Dr Tung found.

Dr Tung said the superficial wounds might have been incurred by such actions. But a hymenal tear, while possible, is "unlikely" to be caused by scratching and rubbing as "the hymen is quite buried inside the folds".

Mr Pereira also asked why the woman only suffered a shallow tear and wounds that Dr Tung estimates to be around one to two millimetres deep, if she had experienced multiple forceful thrusts as she claimed.

He noted that the number of thrusts the woman experienced was not recorded by Dr Tung and accused her of "embellishing evidence" to fit the prosecution's case.

Dr Tung said that the injuries the woman suffered is consistent with her account, regardless whether she experienced a single or multiple thrusts during the alleged rape.

Objecting to defence counsel's line of questioning, Deputy Public Prosecutor Sharmila Sripathy-Shanaz said Mr Pereira's insinuations about Dr Tung were "baseless".

When asked what she felt about Mr Pereira's accusations, Dr Tung only replied: "I'm affronted."
The trial continues as the case's investigation officer takes the stand on Wednesday (May 9).

The police officer leading investigations into rape allegations against a doctor told the High Court on Wednesday (May 9) that when she asked him for a blood sample for DNA tests, general practitioner Wee Teong Boo initially refused.

Assistant Superintendent Carol Ong said that Wee, 67, had told her: "Why should I give you my blood sample. You can only take my DNA if you can find sperm in her vagina but I do not think you can."

Testifying on the seventh day of Wee's trial for molesting and raping his 23-year-old patient during two visits in 2015, ASP Ong said Wee's statement struck her as "unusual" and she made a mental note of it.

The investigator said that in her experience with suspects who turn out to be innocent, they would tell her they were "sure" that their DNA would not be found on their accusers.

Contrasting this with the words "I do not think" used by Wee, ASP Ong said: "There was some uncertainty in his statement."

ASP Ong said this exchange took place on the afternoon of Dec 31, 2015, when she and two other officers went to Wee's clinic in Bedok North Avenue 2, after the alleged victim lodged a police report that he had raped her when she saw him at the clinic late at night on Dec 30.

Wee agreed to give his blood sample at the clinic after she told him she could get a court order to compel him to do so, said ASP Ong. DNA tests eventually proved inconclusive.

Defence counsel Edmond Pereira accused ASP Ong of making up the conversation.

"You made up this evidence just to throw some doubt in this court about Dr Wee's actions," the lawyer contended. ASP Ong disagreed.

Mr Pereira questioned why ASP Ong had not noted the conversation down in her investigation diary. She replied that that there was no reason for her to record the conversation because Wee eventually gave a blood sample.

The lawyer contended that ASP Ong did not speak to Wee at all during the visit. Mr Pereira put it to her that it was her colleague, ASP Razali Razak, who spoke to Wee.

ASP Ong disagreed.

Earlier, on the fourth day of the trial, when ASP Razali was questioned by Mr Pereira, he testified that ASP Ong spoke to Wee that day, although he had left his mobile number with the doctor.

On Wednesday, Mr Pereira also put it to ASP Ong that she had tried to intimidate Wee into admitting to raping the patient.

The lawyer contended that after Wee was taken to the lock-up at the Police Cantonment Complex on Dec 31, ASP Ong met him that night at the reception area and tried to intimidate him into admitting to the rape.

Mr Pereira put it to ASP Ong that she repeatedly told Wee he should know better as a doctor, that DNA evidence would prove he was involved and that it was better for him to admit to the allegations and not get his family involved.

The lawyer contended that during this conversation, Wee told her he did not know how the "finger examination" he performed on the patient would lead to this.

The court earlier heard that Wee's case is that the wounds on the woman's genitals and a fresh tear in the hymen may have been caused when he inserted two of his fingers for a medical examination.

ASP Ong said no such conversation took place. She said she took Wee to the lock-up, but did not see him later that night.

The prosecution closed its case with ASP Ong's testimony.

Justice Chua Lee Ming found that the prosecution had shown a prima facie case against Wee and called for his defence.

Wee indicated he will take the stand on Thursday.
